Paggamit ng anumang uri ng gadgets, ipinagbabawal sa mga testigo ng Impeachment Trial

Naglabas ng ruling ang Senate Impeachment Court tungkol sa paggamit ng gadgets ng mga testigong haharap sa impeachment trial.

Bago ito ay pinabulaanan ni Senate Impeachment Court presiding officer Chiz Escudero ang kumalat na larawan ni OVP Assistant Chief of Staff Lemuel Ortonio sa internet na mayroon itong earpiece sa gitna ng paglilitis.

Paglilinaw ni Escudero, ang viral online photo ni Ortonio na may earpiece ay fake o AI-generated at sa halip, ito ay may hikaw sa front-fold helix ng tenga.

"Again to reiterate, hindi totoo ‘yong lumalabas na ritrato na hindi umano na merong earpiece si mister Ortonio, ‘yon po ay AI. What he had was a front-fold helix, an ear piercing in the front fold helix of his ear not an earpiece", paglilinaw ni Escudero.

Sa ruling ni Escudero, mariing ipinagbabawal sa mga testigo ng korte na gumamit ng earpiece, headsets, cellphones, smart watch, smart glasses o anumang kaparehong devices na maaaring makapag-transmit o makatanggap ng impormasyon o komunikasyon.

Ipinagbabawal din sa mga testigo na tumanggap ng anumang komunikasyon, suhestyon, sumagot sa mensahe o sa taong nasa loob o labas man ng korte.

Mahigpit na ipapatupad ito habang may paglilitis, kahit naka-recess ang korte at hanggang sa pormal na ma-discharge sa witness stand ang testigo.

"Accordingly, no witness while testifying shall possess have access to or use any earpiece, headsets, cellphones, smart watch, smart glasses or any other similar device capable of transmitting or receiving information or communication. Witnesses are also prohibited from receiving or attempting to receive any communications, suggestion, answer signal, message or prompt for any person whether inside or outside of this court, regardless of the means employed. The prohibition shall remain enforce during recesses and until the witness is formally discharge by the court" ani Escudero.

Nagpaalala pa si Escudero na ang bawat testigong haharap sa impeachment court ay magbibigay ng kanilang testimonya batay sa kanyang nalalaman at malaya mula sa coaching o impluwensya ng sinumang counsel o indibidwal.

"The Chair wishes to remind and take this opportunity the parties that every witness must testify nevertheless solely from his and her knowledge, free from coaching or influence from counsel or any other person", dagdag pa ni Escudero.

Ginamit na batayan sa ruling ng impeachment court ang Section 21 E of A.M. Number 241102 ng Korte Suprema kung saan ipinagbabawal ang paggamit ng cellphone, tablets, o kaparehong gadgets kapag may videoconferencing; ang US case Villareal versus Texas kung saan sa testigo mismo magmumula ang impormasyon at hindi idinikta ng anumang partido o counsel; at ang kaso ng Sky Development Inc. versus Vista View.
